Partner Terms and Conditions
Last updated: 29 October 2026
These terms govern the relationship between Dar AlTamaiz Tours (Kuwait, commercial licence no. 7517/2024) and any company that registers on the Partner Portal to list trips, packages and offers. By registering or using the portal, you accept these terms on behalf of your company. The Arabic text governs if the two versions differ.
1. Definitions. Platform: dt-tours.com, dt-tour.com and the Dar AlTamaiz Tours apps. Partner: the registered company offering travel services. Product: any trip, package, tour or service the Partner lists. Customer: anyone who books a Product through the Platform. Commercial Agreement: the annex setting a Partner's specific terms, which prevails over these terms where they conflict.
2. Eligibility and registration. Only companies licensed in their country to operate travel services may register. The Partner provides an accurate trade licence, contact details and bank account (IBAN). We may accept or reject any application without giving reasons and request further documents at any time. Once an application is approved, a personal link is emailed to the Partner's registered address showing the detailed Commercial Agreement (commission amounts, settlement times, confirmation and response deadlines, these terms and the Privacy Policy). An authorised representative clicking "I agree" constitutes the Partner's acknowledgement and acceptance and a binding electronic signature under Electronic Transactions Law No. 20 of 2014. The Platform keeps an acceptance record (signatory name and email, date and time, IP address and the exact version accepted) and emails a PDF copy to both parties. The account cannot sell before this acceptance, and any later change to commissions requires a new acceptance in the same way.
3. Account security. The Partner keeps its Supplier ID and password confidential and is responsible for all activity on its account. Report unauthorised use to info@dt-tour.com immediately. Accounts may not be sold or transferred without written consent.
4. Content and listings. Descriptions must be accurate and complete: itinerary, inclusions and exclusions, hotels, duration, visa and travel requirements. Photos must be genuine and owned or licensed by the Partner. All Products and edits are reviewed before publication; we may edit wording, translation and formatting without changing substance, and reject or hide any non-compliant Product. Misleading content, fake prices and content contrary to Kuwaiti law or public morals are prohibited.
5. Prices and commission. 5.1 Prices are set in Kuwaiti dinars, inclusive of all mandatory taxes and fees. 5.2 The Platform price may not exceed the Partner's price for the same Product on any other channel (rate parity). 5.3 For each completed booking, Dar AlTamaiz Tours earns a fixed commission per traveller: KWD 45 per adult, KWD 30 per child aged 6 or over, KWD 15 per child under 6 (age on the trip start date). For day trips, tours and activities priced under KWD 150 per person, the commission is 25% of the selling price instead. The commission is deducted from the Partner's payout and never added to the Customer's price. These apply unless the Commercial Agreement states otherwise. 5.4 Cashback and discount codes offered by the Platform are funded by the Platform unless agreed otherwise in advance.
6. Bookings. The service contract is between the Partner and the Customer; Dar AlTamaiz Tours acts as booking and payment intermediary. The Partner confirms or declines each request within 24 hours, keeps availability current, and does not decline bookings for Products shown as available. The Partner contacts Customers only for the booking and may not use their data for marketing or divert them to book outside the Platform.
7. Payment and settlement. We collect payment via approved methods (KNET, Visa, Mastercard, Apple Pay, Samsung Pay). The Partner's payout, net of commission, is transferred to its registered bank account within 14 business days after the service ends, unless a complaint is open. A monthly settlement statement is issued in the portal; objections must be raised within 30 days. We are not liable for delays caused by incorrect bank details.
8. Cancellation and refunds. The Partner sets a clear cancellation policy per Product, shown to the Customer before payment. The Partner may not cancel a confirmed booking except for documented force majeure. If it does, the Customer is refunded in full and the Partner bears any price difference for a comparable alternative arranged by the Platform. Force majeure includes natural disasters, epidemics, war, government orders, airport closures and similar events that could not be foreseen or prevented.
9. Quality and reviews. Services must match their description and be delivered professionally and safely. Customers may review after the service. Partners may not post, buy or pressure for reviews. Repeated complaints or persistently low ratings allow us to hide Products or suspend the account.
10. Partner obligations. Hold all licences and insurance required where the service is delivered; keep Customer data and non-public Platform information confidential; never use the Platform for fraud, money laundering or in breach of international sanctions.
11. Intellectual property. Content remains the Partner's; the Partner grants Dar AlTamaiz Tours a non-exclusive, royalty-free licence to use, translate and display it on the Platform, in ads and on social media during the partnership. Our name, logo and Platform design may not be used without written permission.
12. Liability and indemnity. The Partner alone is responsible for delivering the service and for any harm to Customers during it, and indemnifies Dar AlTamaiz Tours against any claim or fine arising from its breach of these terms or the law, or from its content. Our liability to the Partner is capped at the commissions received from it in the previous 12 months and excludes indirect loss and lost profit. We do not guarantee booking volumes, ranking or uninterrupted availability.
13. Suspension and termination. Either party may terminate on 30 days' written notice. We may suspend or terminate immediately for fraud, material breach, expired licence or risk to Customer safety. Bookings confirmed before termination remain valid and must be delivered unless agreed otherwise.
14. Legal compliance. The Partner complies with the laws of Kuwait and of the country of service, in particular: Consumer Protection Law No. 39 of 2014 and its Executive Regulation No. 27 of 2015; Electronic Transactions Law No. 20 of 2014; Ministry of Commerce and Industry Decision No. 109 of 2026 on electronic platforms (all fees shown before payment, clear refund policy, e-invoicing); Anti-Money Laundering and Terrorism Financing Law No. 106 of 2013 and international sanctions lists; and a strict ban on bribery. Air tickets are issued only through Max Travels & Tourism (IATA accredited agent no. 42228745, civil aviation licence 2021/20304); Partners may not sell air tickets through the Platform unless licensed and approved in writing.
15. Customer data protection. Each party is an independent controller of the data it processes and complies with CITRA Data Privacy Protection Regulation No. 26 of 2024. The Partner uses Customer data (name, passport, contact) only to deliver the booking and deletes it when no longer needed unless the law requires retention. For Customers resident in the EU or UK, the Partner also complies with the GDPR. The Partner reports any breach affecting Customer data within 24 hours of discovery.
16. Complaints. The Partner responds to any complaint within 48 hours. The Platform keeps a record of complaints and actions taken. Where the Partner is at fault, the Platform may refund the Customer and deduct the amount from the Partner's payout after notifying the Partner and giving it a chance to respond.
17. Taxes and invoices. The Partner is responsible for its own taxes and fees. We issue an electronic invoice for commissions with each settlement statement. Any future tax on commission is added as required by law.
18. Insurance and safety. The Partner maintains valid civil liability insurance covering its activities, provides a copy on request, and ensures guides, drivers, vehicles and facilities are licensed and safe.
19. Relationship. The parties are independent; nothing here creates a partnership, agency or employment. The partnership is non-exclusive; the Partner may sell elsewhere subject to clause 5.2.
20. General. Acceptance through the portal is a binding signature under the Electronic Transactions Law, and electronic records are admissible evidence. Notices go to the account's registered email and are deemed received when sent. The Partner may not assign its rights without written consent. An invalid clause does not affect the rest. Failure to enforce a right is not a waiver. These terms, the Commercial Agreement and the Privacy Policy are the entire agreement. Liability, indemnity, confidentiality and data clauses survive termination.
21. Changes. We notify Partners of material changes by email and in the portal 30 days before they take effect; continued use means acceptance.
22. Governing law and disputes. Kuwaiti law governs. The parties will try to settle any dispute amicably within 30 days, failing which the courts of Kuwait have jurisdiction. The Arabic text prevails over the English.
